Terms and Conditions of Use for Submitting Images to Nickelodeon UK via iCarly.com

Whenever you send a photograph, recording, video/mobile clip, drawing or any image (?the Image(s)?) to Nickelodeon UK (?Nick UK?), you agree to the following terms and conditions:

1. Nick UK may use the Image(s) in all media throughout the world in perpetuity as Nick UK in its sole discretion deems fit, including without limitation, showing the Image(s) on-air and/or on the web. However, Nick UK is not obliged to use the Image(s) submitted.

2. Before sending in the Image(s) to Nick UK, you must obtain your parents?/guardians? consent for Nick UK?s use of and rights to the Image(s) as contemplated by these terms and conditions.

3. Before sending in any Image(s) (except in respect of drawings) to Nick UK, you must also obtain:

1. the consent of every person in the Image(s) (and/or their parents/guardians);

2. a waiver of all moral rights from every person in the Image(s) and/or creator/owner of the Image(s) (and/or their parents/guardians); and

3. if the Image(s) is/are not yours, the consent of the person, who took and/or owns the Image(s) (and/or their parents/guardians); for Nick UK?s use of and rights to the Image(s) as contemplated by these terms and conditions.

4. You waive all moral rights in the Image(s).

5. You must pay the costs of sending the Image(s) to Nick UK. Costs to send the Image(s) to Nick UK, whether by post, mobile phone or the Internet, may vary so please check with the post office, your telecommunications network provider or your internet service provider for current charges.

6. You must obtain the permission of the person paying the bill before sending the Image(s).

7. You agree that you will not send to Nick UK any Image(s) which are rude, obscene, defamatory or unsuitable for children.

8. The Image(s) will not be returned and will become the property of Nick UK.

9. No responsibility can be accepted for Image(s) lost, delayed, misdirected, damaged or undelivered. Nick UK shall not be responsible for any technical errors in telecommunications networks or Internet access that prevent you from sending the Image(s) to Nick UK.

10. Nick UK shall not be liable to you, your parents?/guardians? and/or any person in the Image(s) (including their parents?/guardians?) for any loss (including without limitation, loss of reputation), damage, defamation, and/or invasion of privacy howsoever caused arising out of or in connection with you submitting the Image(s) to Nick UK.

11. In consideration of the sum of ?1.00 to you by Nick UK (which you acknowledge receipt of), you irrevocably agree that:

1. all rights, titles and interests to all intellectual property rights in the Image(s) (including copyright and design rights) shall belong and be assigned (with full title guarantee) to Nick UK absolutely worldwide (both present and future) in perpetuity; and

2. the consideration shall be a full payment for the right to exploit the rights assigned under these terms and conditions and includes an equitable pre-payment for the right to exploit all lending and rental rights.

12. By submitting the Image(s), you acknowledge that the Image(s) may be used without payment or further consent. Such use may include without limitation your name and/or likeness, voice and/or biographical information provided by you and/or any statement made by you to Nick UK. You agree that any or all such elements may be used by Nick UK in any and all media in perpetuity throughout the world as Nick UK in its sole discretion sees fit.

13. Any personal information, including without limitation, your name, age, address (including postcode), telephone number and/or email address will be used solely in connection with the submission of the Image(s) and will not be disclosed to any third party.

14. These standard terms and conditions of use shall be governed by and construed in accordance with the laws of England and the courts of England shall have exclusive jurisdiction in relation to any disputes.
